	It is your responsibility to read this agreement carefully to understand your rights and obligations before you participate in the program offered by Phoneiscash.com. By participating in the Phoneiscash.com Program you are accepting the terms & conditions outlined below.
	1	Each cell phone must be fully functional. That means it must power on, LCD displays work and not broken or bleeding, keypad works, scroll bars works, no corrupt software, no security code or password enabled, no broken antenna, no water damage, no loose or broken flip, display light comes on, display light comes on, ringer works, speaker and microphone work, camera works and does not has any crack on the body. A red dot that has "bled" beneath your battery on your phone is an indication that it has come in contact with moisture or water and we cannot buy this phone.
	2	If you've enabled the phone with a security code or password, you must disable it or reset the password/code to 0000. We will not accept any phones that require a security code or password.
	3	When you ship your phone(s), make sure they are packed well so that upon arrival they will not be crushed or otherwise damaged from shipping. We do not accept liability associated with damaged merchandise sent to us.
	4	Please do not attempt to sell a phone that is stolen or one that has been found; it will be reported to proper authorities.
	5	PHONES WITH SIM CARDS DO NOT NEED TO BE RELEASED OR HAVE A ZERO BALANCE. All others MUST be released and have a zero account balance. Phones that have not been released or carry an unpaid balance may be returned, but at owners' expense (to include shipping and rejection fees).
	6	Each cell phone must have valid and verifiable IMEI or ESN Serial Number. That means we will not accept a phone that is missing the serial number sticker inside or is scratched off of blotted out.
	7	Phone(s) that arrive with non-working batteries will be accepted but a $25.00 battery replacement fee will be deducted from your phone(s) purchase price.
	8	We will pay you for the phone(s) after 30 business days of receipt and processing. You will be paid by Company Check via US First Class Mail.
	9	Any ITEM that works on the Sprint, Verizon, Nextel, Alltel, US Cellular, Cellular One, or Qwest network must be deactivated and have no remaining outstanding balance on the account. If an ITEM is not deactivated or has an outstanding balance, the final value will be reduced to zero.
	10	Phoneiscash.com IS NOT RESPONSIBLE FOR REMOVING INFORMATION FROM MY ITEM AND CANNOT GUARANTEE THAT ALL INFORMATION LEFT ON MY ITEM WILL BE DELETED. IT IS MY RESPONSIBILITY TO DELETE ALL PERSONAL/SENSITIVE INFORMATION FROM MY ITEM BEFORE I SUBMIT IT TO Phoneiscash.com.
	11	Phone(s) must ship to Phoneiscash.com within 30 days of the day you accept the credit offered.
	12	IT IS YOUR RESPONSIBILITY TO REMOVE US FROM YOUR SPAM BLOCKER. ALL CORRESPONDENCE IS CONDUCTED VIA EMAILS.

	13	Once you submit a Purchase Request to sell your phone, we will process that order and send you a notification via email indicating that we have received your submission, reviewed it, and conditionally accepted it. It is conditional because we have not yet had an opportunity to view the product and test it.
	14	Once we receive your phone, we will send you an email indicating that your phone has arrived and is being "processed". Processing can take several weeks due to volume, so please be patient.
	15	Payment will be made after 30 business days of the receipt of cell phone(s).
	16	We will answer all emails submitted by members selling their phones. Please allow us a maximum of 24 hours to respond. (We are not open on Holidays and Weekends)
	17	No matter how many phones you submit, we treat each phone as though it has it's own contract. Therefore, if you send more than one phone and one of them is in less than acceptable condition, all the others will proceed as originally designated and the processing of the rejected phone(s) will stop. We will submit an email to you indicating the reason for it's rejection. You will be required to pay for return shipping and handling associated with the processing of your phone thus far, should you want it back. A handling fee is $10.00. Shipping is $4.00 for the first unit of cell phone and $2.50 for each additional unit. Return fee must paid within 10 business days. If return fee is not paid after 10 business days, PhoneisCash.com will dispose/recycle all disqualified handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s). PhoneisCash.com is not liable for any disposed/recycled handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s).
	18	Phoneiscash.com is not responsible for any lost or stolen packages during shipment.
	19	In the rare event that an exception is made, PhoneIsCash.com can only guarantee that you will receive the same model, not the exact phone(s) that were sent in. If the unit was working, you will receive back a working unit. If the unit was defective you will receive back a non-working unit.
	20	All pricing is subject to change without notice. For all prices, products and offers, Phoneiscash.com reserves the right to make adjustments due to changing market conditions, product availability, and other extenuating circumstances.

Registration

Our services are available only to registered users who are 18 years old or older and can form legally binding contracts under applicable law. Our services are not available to minors. Your use of PhoneisCash.com may be terminated or suspended by us if you do not comply with this Agreement, our policies and procedures, or for any other reason we determine necessary, in our sole discretion, to protect us and other users of the site.

Trade Acceptance Policy

The shipment of your cell phone(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) confirms your acceptance of our price and condition offer. Under no circumstances will cell phone(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) be returned unless our offer is different that originally agreed to.

Your receipt of a trade confirmation only signifies that PhoneisCash.com will pay full value if the handset(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) sent are in acceptable condition as outlined below.

Condition of cell phone(s)

In order to qualify for payment, all cell phone(s) must be in working condition. Each cell phone must be fully functional. That means it must power on, LCD displays work and not broken or bleeding, keypad works, scroll bars works, no corrupt software, no broken antenna, no water damage, no loose or broken flip, display light comes on, display light comes on, ringer works, speaker and microphone work, camera works and does not has any crack on the body. A red dot that has "bled" beneath your battery on your phone is an indication that it has come in contact with moisture or water. We cannot buy this phone. Top Dollar is paid for quality phones. To obtain this, each cell phone must be in working condition. That means it should meet all the functions mention above.

All phones must power up and the cell phone must be able to make a call.

Any cell phone(s) sent in other than those listed on the initial transaction will not be returned and will become the property of PhoneisCash.com. These units will be recycled or donated to non-profit organizations. Please verify the accuracy of your transaction before submitting for approval. If you wish to change your transaction simply contact Customer Service online.

Condition of Game(s)

In order to qualify for payment all game(s) must be in working condition. They will run smooth and playable. We do not purchase IMPORT games. All items and prices listed are for US/North American NTSC format merchandise. We do not purchase copied/pirated games. We reserve the right to refuse any purchase. We co-operate with local, state, and federal authorities and make all information submitted during the buyback process available to them upon request. All games shall have a valid UPC code corresponding to each game.

In order to qualify for payment all Apple iPod(s) must be in working condition. All Apple iPods sent in must be fully functional. Apple iPods must be owned by the individual participating in this transaction. Apple iPods that have had the external case opened by anyone except for Apple are not accepted. Apple iPods with cracked/broken cases, track wheels not working, cannot power on, dead battery or have a broken LCD are not accepted. All Apple iPods shall have a valid Serial Number.

Condition of Sony Playstation Portable (PSP) Console(s)

In order to qualify for payment all Sony Playstation Portable(PSP) Console(s) must be in working condition. All Sony Playstation Portable(PSP) Consoles sent in must be fully functional. Sony Playstation Portable(PSP) Consoles must be owned by the individual participating in this transaction. Sony Playstation Portable(PSP) Consoles that have had the external case opened by anyone except for Sony are not accepted. Sony Playstation Portable(PSP) Consoles with cracked/broken cases, joysticks or keypad not working, cannot power on, dead battery or have a broken LCD are not accepted. All Sony Playstation Portable(PSP) Console(s) shall have a valid Serial Number or UPC Number.

Cell Phone Services

It is the responsibility of the user to discontinue service on cell phone(s) sold to PhoneisCash.com before initiating a transaction. PhoneisCash.com is not responsible for previous or subsequent airtime charges accrued prior, during, or after any transaction. Should any airtime charges be accrued, it is the responsibility of the original user and service provider to resolve payment issues.

Personal / User / Subscriber Information

If desired, it is the responsibility of the user to remove any and all personal information from all cell phone(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) memory and removable memory including but not limited to, phonebook entries, personal codes, e-mail addresses, personal addresses, IM addresses, photos, and downloaded files. Any personal information including but not limited to the aforementioned data could be used in a negative manner and it is the sole responsibility of the user to clear all information that could be harmful to the user if made public.

Expiration of Offer

All trade offers will expire 30 days from the date of trade confirmation. All confirmed trade pricing will be honored within the 30 day period regardless of current pricing.

Returns

All disqualified or not accepted cell phone(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) will return at users expense via a handling fee of $10, shipping fee is $4.00 for the first unit of item and $2.50 for each additional unit of item. Return fee must paid within 10 business days. If return fee is not paid after 10 business days, PhoneisCash.com will dispose/recycle all disqualified cell phone(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s). PhoneisCash.com is not liable for any disposed/recycled cell phone(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s).

NOTE: User must make sure they can receive e-mails from PhoneisCash.com. PhoneisCash.com is not responsible for any e-mails that are blocked or spam filtered. Once the disqualified transactions are disposed/recycled theres no way for PhoneisCash.com can return the disqualified cell phone(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s) back to the user.

Disqualified Transaction

PhoneisCash.com will not be responsible for user delays. User must respond to the Disqualified notification e-mail within 10 business days or PhoneisCash.com will dispose/recycle all disqualified cell phone(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s). PhoneisCash.com is not liable for any disposed/recycled cell phone(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s).
